- Eligibility
– You must be 18+ and able to contract under your country’s data and consumer laws (Kenya’s Data Protection Act 2019; Uganda’s Data Protection and Privacy Act 2019; Tanzania’s Data Protection Act 2022). - Accounts
– Register with accurate name, email, phone, and company details.
– Secure your password and notify us immediately of any breach. - Profile Information
– You may enter personal and business details (name, contact, tender preferences) to receive tailored alerts.
– You cannot upload documents or other files to the Site. - Tender Alerts
– Opt‑in for email/SMS notifications; unsubscribe anytime.
– SMS via local carriers (e.g., Safaricom, MTN, Airtel) follows their unsubscribe procedures. - Fees & Billing
– Paid features billed in KES, UGX, or TZS at prevailing central bank rates.
– Fees are non‑refundable; changes announced 30 days in advance. - Intellectual Property
– All Site content (text, logos, code) is owned or licensed by Tenders Afrique EA Gateway Limited.
– Personal, non‑commercial use only. - Disclaimer & Liability Cap
– The Site is provided “as‑is.”
– Our maximum liability is the local‑currency equivalent of KES 5,000 per user; we’re not liable for indirect or consequential damages. - Indemnity
– You agree to defend and indemnify us against claims arising from your use or breach of these terms. - Termination
– You may close your account at any time.
– We may suspend or terminate access for any breach. - Governing Law & Disputes
– Governed by Kenyan law, with respect to regional data laws.
– Disputes proceed first to mediation in Nairobi; if unresolved, to arbitration under Kenya’s Arbitration Act, 1995 (seat: Nairobi).
